From the bankruptcy report of mr AHJ Dunselman about Mobility ID BV, the company behind taxiboeken.nl, it appears that despite an appeal to the provisions of article 105 b Bankruptcy Act the accountant was reluctant to make the relevant administration fully available to the trustee. The bankruptcy trustee also annulled the loan agreements and the associated pledges on the grounds of a creditors' disadvantage.

Accumulation of problems during the investigation

In connection with unpaid invoices, an external administration office has not agreed to make the entire administration available. In connection with a claim from an auctioned website, the builder of a website only made the login codes available after payment of an amount of € 5.000.

For 2019, the administration of Mobility ID BV was processed by an external administration office in the Exact package. The accountant appeared to have blocked the login code to the Exact program. The accountant appeared to have removed the already processed administration from the package due to the non-payment of a few invoices and made the administration - incorrect - available to the curator.

Cause of it bankruptcy

As a result of, among other things, longer payment terms from larger clients of Mobility ID BV, small margins on orders and excessive costs, Mobility ID BV turned out to be loss-making and the company was structurally in liquidity problems. The figures show that since the company was founded, it has been in a loss-making situation for years. The most recently deposited annual accounts relate to the 2017 financial year on 4 January 2019. The 2018 annual accounts have not been prepared.

At the request of Mobility ID BV dated November 6, 2019, Mobility ID BV has been granted a provisional suspension of payments with the appointment of Mr. AHJ Dunselman as administrator. In connection with the lack of prospects that Mobility ID BV would be able to satisfy its creditors over time, the provisional suspension of payments was withdrawn at the request of the bankruptcy trustee dated 7 November 2019 and Mobility ID BV was withdrawn by the same decision on 7 November 2019. declared bankrupt.

25% bonus on redemption

An important investor in Mobility ID BV had indicated in the course of 2018 that it wished to withdraw, after which the director of Mobility ID BV attempted to find new investors in the company. In the autumn of 2018, the director came into contact with a party, which represented several investors. 

This contact resulted in the conclusion of loan agreements around April 1, 2019 with the respective individual investors up to a total amount of € 150.000, while the director himself made an investment of € 25.000. The investors negotiated a bonus of 25% on the repayment of the nominal loan in addition to interest. They also stipulated a pledge on receivables.

In the bankruptcy report indicates the curator to further investigate possible improper management and acts of Pauline conduct. The agenda also includes research into administration and compliance with accounting obligations. Up to and including 2018, the administration was processed by Flynth Accountants, and the aforementioned accountancy firm prepared the annual accounts up to and including 2017. Flynth Accountants also made the declaration for the turnover tax or payroll taxes or corporate tax.

Mobility ID BV was the holder of a large number of domain names and two websites. 26 domain names and two websites were offered through BVA. The total sales proceeds at the auction for the domain names and websites amounted to a total amount of € 32.131 excluding VAT.
