Both parties have now established that there are good reasons to return these aviation tasks to the ILT.

The Minister of Infrastructure and Water Management and Kiwa NV recently signed a declaration of intent for the transfer of specific aviation tasks from Kiwa to the Human Environment and Transport Inspectorate (ILT). This step emphasizes the importance that both parties attach to aviation safety and the need to carry out tasks efficiently and effectively.

The background to this letter of intent lies in an agreement that the parties concluded on July 10, 2009. This agreement, which was later amended several times, regulated the transfer of certain tasks from the government to Kiwa. These tasks also include aviation certificates, which are now once again the subject of discussion. Both parties have now established that there are good reasons to return these aviation tasks to the ILT.

The letter of intent states that the parties will work on a final transfer agreement. This will, among other things, regulate the financial aspects of the transfer. This transfer falls under the legal provisions of 'transfer of business' as laid down in Articles 7:662-666 of the Civil Code. This means that employees who currently work at Kiwa and perform specific aviation tasks have the right to transfer to the ILT. The inspectorate is obliged to make these employees an offer that is equivalent to their current employment contract with Kiwa.

To ensure the continuity of aviation tasks, both parties will make every effort to ensure a smooth transition. This means that they will jointly investigate whether it is possible for the ILT to temporarily use Kiwa's ICT systems. The possibility of the ILT continuing to use these systems in the longer term is also being examined. The reasonable compensation that the ILT must pay to Kiwa for this will be part of this investigation.

In addition, the works councils and trade unions will be closely involved in this transition. This is to ensure that the interests of employees are well represented and the transition goes smoothly.

An important aspect of this transition is communication with third parties. The parties have agreed to quickly draw up a joint communication statement. This statement will be actively distributed to inform all stakeholders and stakeholders of the changes that will take place.

The Inspector General of the ILT will inform the Minister of Infrastructure and Water Management about the progress and details of this transfer. Kiwa will be given the opportunity to respond substantively prior to this communication.

De letter of intent enters into force as soon as both parties have signed it. An important step in the restructuring of aviation tasks in the Netherlands, with the aim of even safer and more efficient execution of these crucial activities.
