The judge's ruling comes as no surprise to the umbrella organization for airlines Barin.

In summary proceedings, the court ruled that the cabinet was not allowed to take the decision to allow fewer aircraft to depart from the airport. Environmental organizations are disappointed with the ruling.

Can the cabinet prescribe that the number of flights at Schiphol will be reduced from the end of this year? That question was discussed today in the court in Haarlem. The judge judges now that the State has not gone through the correct procedure before the government announced the contraction at Schiphol.

The State may predetermine the number of air transport movements Schiphol Airport not reduce from 2023 to 2024 for the 500.000/460.000 season. The court rules that the State has not gone through the correct procedure. That means that Schiphol Airport as a result of this decision, the maximum number of flights may not be reduced to 460.000 for the coming season.

In June last year, Minister Harbers of Infrastructure and Water Management announced that from 1 November 2023, the maximum number of flights that Schiphol is allowed to operate must be reduced.

KLM, together with its American partner Delta and the global aviation umbrella organization IATA, had filed a case against the reduction in take-offs and landings. Minister Harbers is considering possible 'next steps', says a spokesman for the Ministry of Infrastructure. 

The parties to this lawsuit against the State were A4A, Air Canada, British Airways, Vueling, United, Jetblue and FedEx, KLM, KLM Cityhopper, Transavia, Martinair and Delta, Lufthansa, TUI, Corendon and easyJet. Whether Schiphol will shrink next year is also the question.
